Terms of Use (Kullanım Koşulları)

1. BINDING AGREEMENT AND LEGAL CAPACITY

1.1. Contractual Relationship: These Terms of Use (“Terms”) constitute a legally binding agreement between you, whether personally or on behalf of an entity (“User”, “you”) and GDS EĞİTİM DANIŞMANLIK VE TEKNOLOJİ ANONİM ŞİRKETİ (“Company”, “GODDESS”, “we”, “us”, or “our”).

1.2. Acceptance: By accessing the Goddess mobile application, website, and associated services (collectively, the “Service”), you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.

1.3. Eligibility: To register for an account, you must be at least 18 years of age or the legal age of majority in your jurisdiction. Individuals under the age of 18 may only use the Service under the direct supervision and with the explicit consent of a parent or legal guardian who agrees to be bound by these Terms.

2. MEDICAL AND WELLBEING DISCLAIMER (LIMITATION OF RESPONSIBILITY)

2.1. Informational Purposes Only: GODDESS provides content related to meditation, yoga, sleep, psychology, and general wellbeing. THE COMPANY IS NOT A MEDICAL ORGANIZATION, AND OUR STAFF ARE NOT LICENSED MEDICAL PROFESSIONALS.

2.2. No Medical Advice: The Service and its content do not constitute medical advice, diagnosis, or treatment. No doctor-patient relationship is formed between you and the Company.

2.3. Consultation Required: You represent that you are in good health. You should consult with a physician or other healthcare professional before starting any physical or mental wellbeing program, particularly if you are pregnant, nursing, have a pre-existing medical condition, or are taking medication.

2.4. Assumption of Risk: By using the Service, you voluntarily assume all risks associated with any physical or mental activities provided. To the maximum extent permitted by law, GODDESS shall not be liable for any injury, health complications, or damages resulting from the use of the Service.

2.5. Crisis Intervention: GODDESS is not a crisis service. If you are experiencing a medical emergency or mental health crisis (such as suicidal thoughts), you must immediately contact local emergency services or a qualified medical professional.

3. SUBSCRIPTIONS, BILLING, AND CANCELLATION

3.1. Subscription Tiers: Access to certain premium features (“Premium Service”) requires a paid subscription (e.g., monthly, semi-annual, or annual plans).

3.2. Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel the auto-renewal at least twenty-four (24) hours before the expiration of the current period.

3.4. Price Changes: We reserve the right to adjust pricing for the Service. Any price changes will take effect following notice to you via email or in-app notification.

4. REFUND AND WITHDRAWAL POLICY

4.1. Payment Processing: All digital product sales and subscription transactions on this website are conducted through an authorized Merchant of Record or a third-party payment service provider. The authorized reseller is responsible for the secure processing of payments, tax collection, and the fulfillment of refund requests in accordance with applicable consumer laws.

4.2. Statutory Right of Withdrawal: In compliance with international consumer protection standards (including the EU Consumer Rights Directive), Users residing in eligible jurisdictions have the right to withdraw from their purchase within fourteen (14) days of the transaction date without providing a justification.

4.3. Digital Content Performance: By purchasing a digital subscription, you acknowledge and agree that accessing, streaming, or downloading any premium digital content (e.g., meditations, courses, or exclusive features) constitutes the commencement of the service. Once the performance of the digital service has begun with your prior express consent, your right to a full refund may be subject to the specific refund criteria of the Payment Service Provider.

4.4. Refund Requests: To initiate a refund or exercise your right of withdrawal, you must contact the customer support of the Payment Service Provider identified on your receipt or contact us at support@thegoddessapp.com. All approved refunds will be credited back to the original payment method used at the time of purchase within a reasonable timeframe.

4.5. Subscription Cancellations: Users may cancel their recurring subscriptions at any time. Cancellation will stop future billing; however, unless required by mandatory local law, the Company does not provide prorated refunds for the remaining portion of a current billing cycle.

4.6. Mobile App Store Transactions: This policy applies solely to direct website purchases. Any transactions made via the Apple App Store or Google Play Store are subject to the terms and conditions of those platforms. The Company cannot intervene in, or process refunds for, payments managed by third-party mobile application stores.

5. INTELLECTUAL PROPERTY RIGHTS

5.1. Ownership: Unless otherwise indicated, the Service is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the “Content”) and the trademarks, service marks, and logos (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

5.2. Limited License: Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only.

5.3. Restrictions: You shall not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit for any commercial purpose whatsoever, without our express prior written permission.

6. USER CONDUCT AND PROHIBITED ACTIVITIES

You may not access or use the Service for any purpose other than that for which we make the Service available. Prohibited activities include, but are not limited to:

• Systematically retrieving data or other content from the Service to create or compile a database or directory.
• Circumventing, disabling, or otherwise interfering with security-related features of the Service.
• Engaging in unauthorized framing of or linking to the Service.
• Using any automated system, such as scripts, robots, or spiders, to scrape or harvest data.
• Attempting to impersonate another user or person.
• Using the Service as part of any effort to compete with us or for revenue-generating endeavors.

7. TERM AND TERMINATION

7.1. By User: You may terminate your account at any time by following the instructions within the App settings.

7.2. By Company: We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Service (including blocking certain IP addresses) to any person for any reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms.

8. LIMITATION OF LIABILITY AND INDEMNIFICATION

8.1. Limitation of Liability: To the maximum extent permitted by applicable law, in no event will GODDESS or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, or loss of data arising from your use of the Service.

8.2. Indemnification: You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of: (1) your use of the Service; (2) breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms.

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1. Governing Law: These Terms and your use of the Service are governed by and construed in accordance with the laws of the Republic of Turkey.

9.2. Jurisdiction: Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted exclusively in the Istanbul (Central) Courts and Execution Offices.

9.3. Mandatory Consumer Rights: Notwithstanding Section 9.1 and 9.2, if you are a resident of the European Union or the United States, you may benefit from mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

10. MODIFICATIONS TO THE SERVICE AND TERMS

We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. We also reserve the right to amend these Terms at any time. We will alert you about any changes by updating the “Last updated” date of these Terms, and you waive any right to receive specific notice of each such change.
